Terms of Service

1. Agreement to Terms

By downloading, installing, or using the FooZenie mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and IOriented Digital Creations Limited ("we", "our", or "us").

2. Description of Service

FooZenie is a recipe management application that allows you to:

• Create, save, and organize recipes
• Import recipes from websites and videos
• Generate recipes using AI assistance
• Create AI-generated images for recipes
• Manage shopping lists and pantry items
• Use text-to-speech for hands-free cooking
• Import recipes from physical cookbooks (PDF/scan)
• Browse and share community recipes

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscription and Payments

4.1 Free and Premium Tiers

The App offers free, Plus, and Pro subscription tiers. Free tier users have limited access to certain features including recipe storage limits, daily AI usage limits, and image generation limits.

4.2 Subscription Terms

Paid subscriptions are billed on a recurring basis (monthly or yearly, depending on the plan you select). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription through your device's app store (Google Play Store or Apple App Store).

4.4 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after the price change constitutes your agreement to pay the new price.

4.5 Refunds

Refund requests are handled by the respective app store (Google Play or Apple App Store) according to their refund policies. We do not process refunds directly.

5. User Content

5.1 Your Content

You retain ownership of recipes, images, and other content you create or upload to the App ("User Content"). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you.

5.2 AI-Generated Content

Recipes and images generated by AI features are provided for your personal use. You may use AI-generated content freely, but we make no guarantees about the accuracy, safety, or suitability of AI-generated recipes. Always use your own judgment when cooking.

5.3 Community Content

By sharing recipes publicly through the community feature, you grant other users the right to view, save, and fork your shared recipes. You may make recipes private at any time.

5.4 Prohibited Content

You agree not to upload or create content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App or servers
• Use automated systems to access the App (bots, scrapers, etc.)
• Circumvent or attempt to circumvent usage limits or restrictions
• Share your account credentials with others
• Resell or redistribute the App or its features

7. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by IOriented Digital Creations Limited and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any proprietary notices from the App
• Use our trademarks without permission

8. Disclaimers

8.1 Service Provided "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the App will be uninterrupted, error-free, or secure.

8.2 Recipe and Nutritional Information

Recipes and nutritional information in the App are for informational purposes only. We make no guarantees about accuracy, completeness, or suitability. Always verify ingredients for allergens and dietary restrictions. Consult a healthcare professional for dietary advice.

8.3 AI-Generated Content

AI-generated recipes and content may contain errors or inaccuracies. Use AI features at your own discretion. We are not responsible for any adverse effects from following AI-generated recipes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IORIENTED DIGITAL CREATIONS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless IOriented Digital Creations Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by:

• Canceling your subscription through your app store
• Requesting account deletion through the App settings
• Contacting us at support@ioriented.com

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Hong Kong.
